Welcome to Volunteer-well.org

The following terms of service (these “Terms of Service”), govern your access to and use of the Volunteer Well website and mobile application, including any content, functionality and services offered on or through www.voluntere-well.org or the Volunteer Well mobile application (jointly as well as separately referred herein after as the “Site”) by The Volunteer Well. The Volunteer Well ((herein after referred as The Charity) is a registered non-profit federally registered charity based in Ontario, Canada with the purpose to address and prevent specific problems faced by women, LGBTQ++, marginalized people in financial need, new immigrants and Black, Indigenous and People of colour families facing disadvantages, such as poverty and unemployment by providing programs beneficial to the community that are charitable at law, such as job mentorship workshops and health resources, that teach a variety of life skills as well as integration into Canadian society to help them become active members /volunteers of their community; to relief conditions attributed to being aged by providing a variety of programs that will help alleviate social isolation and loneliness; to address and prevent specific problems faced by children and youth by providing a variety of programs that will assist with overall development, teaching life skills and helping become active members/volunteers in their community; and to do all such things as are ancillary and incidental to the attainment of this charitable purpose. The Charity, or any of the Charity’s partners, employees, associates, affiliates, or subsidiaries, for the purpose of the Volunteer Well’s site, are collectively referred hereto as “Volunteer Well” “we” or “us”, whereas “you” or “Subscriber” means you as a Subscriber of the Site.

Please read the Terms of Service carefully before you start to use the Site. By using the Site, opening an Account, subscribing to any of the services or products offered it as a user, listing yourself as volunteer, listing any of your products or services as volunteer, using any of these services or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Terms of Service, which is incorporated herein by reference. You further acknowledge, you have read and understood our Privacy Policy. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the Site.

This Site is offered and available to Subscribers who are at least 18 years of age and of legal age to form a binding contract. If you are under 18 and at least 13 years of age, you are only permitted to use the Site through an Account owned by a parent or legal guardian with their appropriate permission. If you are under 13 you are not permitted to use the Site or the Volunteer Well services. By using the Site, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site

The original language of these Terms of Service, as well as all other texts throughout the Site, is English.

Key Terms

Subscribers are those who use Volunteer Well Site, either as those who use the Volunteer services (Users) or those who post such services (Volunteers).

Volunteers are Subscribers who volunteer and perform services through their Volunteer page on Volunteer Well.

Users are Subscribers who use the services offered by the Volunteers. The Subscribers can be both users as well as Volunteers.

Account is a collaborative account for each Subscriber, created via Volunteer Well Site, as detailed on Volunteer Well Terms of Service (available here).

Custom Offers are exclusive proposals that a Volunteer can create in response to specific requirements of a User.

Custom Requests are requests made by a User to receive a Custom Offer from a Volunteer.

Volunteer Services are services, products, hours, skills, etc. as offered on Volunteer Well Site by Volunteers under any of the defined categories as per the Site.

Overview – Main terms

Only registered Subscribers may request and use Volunteer Services as well as offer services as Volunteers on Volunteer Well Site. Registration is free for the Subscribers.

By using this Site, you agree to have read and understood the Terms and Conditions as well as the Privacy Policy of Volunteer Well and hold Volunteer Well harmless against all actions, loss, damages, claims and penalties arising from any breach by Subscribers (including yourself) of the Terms and Conditions, access and/or exploitation of the Site.

In registering for an Account, you agree to provide us with accurate, complete and updated information and must not create an Account for fraudulent or misleading purposes. You are solely responsible for any activity on your Account and for maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your Account.

Volunteers on Volunteer Well Site are recommended and strongly urged to offer their Volunteer Services, free of cost, i.e., without charging anything to the Users and hence these services must be offered free of cost.

Users can opt for these Volunteer Services.

Volunteers must fulfill their Requests, and may not cancel Requests on a regular basis or without cause. Cancelling Requests will affect Volunteers’ reputation and status.

Volunteers gain higher review ratings based on their performance and reputation, and thus would be shown in the Reviewed Volunteer Services section on the Home page of Volunteer Well Site.

Subscribers (Both Users and Volunteers) must not offer or accept payments, request for or carry out any shipping through Volunteer Well Site.

Volunteer Well retains the right to use all Volunteers Services and listed Services for Volunteer Well marketing and promotion purposes.

Volunteer Well does not handle or guarantee any exchange of money, cash, or shipping between the Volunteers and Users. Volunteer Well is not responsible for any services, transactions or money transfers or exchange of any sort. Every Subscriber, either as a Volunteer or a User, has to do their own due diligence and comply with these Terms and Conditions.

Some Non-Permitted Usage of the Volunteer Well Site

Volunteer Well is an open to everyone online Volunteering Platform. Every subscriber, whether as volunteer or user, undertakes not to discriminate against any Subscriber, User or Volunteer of this forum based on gender, race, age, religious affiliation, sexual orientation or otherwise you acknowledge that such discrimination may result in the suspension/removal of your Account.

Subscribers, Volunteers and/or Users, may be removed by Volunteer Well Site for violations of any Terms of Service, which may include (but are not limited to) the following violations:

- Illegal or Fraudulent services
- Copyright Infringement, Trademark Infringement, and violation of a third party’s terms of service reported through our Intellectual Property Claims Policy found here
- Intentional copies of other Subscribers
- Adult oriented services, Pornographic, Inappropriate/Obscene.
- Rude, abusive, improper language, or violent messages will not be tolerated and may result in an Account warning or the suspension/removal of your Account.
- Spam, nonsense, or violent or deceptive Subscribers, i.e. either as Volunteer or User
- Volunteers misleading to Users or others
- Use of the Site for any commercial activities, promotion or selling purposes
- Reselling of regulated goods
- Offering to prepare academic works on behalf of Users or others
- Promoting Subscribers, Users or Volunteers, or any of such activities that are prohibited by any laws, regulations, and/or third parties’ terms of service, as well as through any marketing activity that negatively affects our relationships with our Subscribers or partners.
- Promoting content, which violates Volunteer Well’s Terms of Service.
- Discrimination against any fellow human being or indulging in any act that discriminates against any Subscriber, User or Volunteer of the Site based on gender, race, age, religious affiliation, sexual orientation, geographical or any other background.
- In addition to and continuation of the above, following are strictly prohibited.
  - Adult Services & Pornography – Volunteer Well does not allow any exchange of adult oriented or pornographic materials and services.
  - Inappropriate Behavior & Language – Communication on Volunteer Well should be friendly, constructive, and professional. Volunteer Well condemns bullying, harassment, and hate speech towards others.
  - Phishing and Spam – Subscribers’ security is a top priority. Any attempts to publish or send malicious content with the intent to compromise another Subscriber’s Account or the virtual Volunteer Well community’s environment is strictly prohibited.
  - Payment Routed through the Site: The Volunteer Well Site can not be used for any offer or request of payment, by and to any Subscriber, Volunteer or User whether in consideration of delivered services or otherwise in any shape or form. The charity does not recommend, any services to be charged or any request for payment even in the form of donation to any other Subscriber. The Volunteer Well shall not be responsible or liable for any damages or other problems resulting from such offers or requests if the subscribers, either as Volunteers or Users, opt for payment in any shape or form.
  - Privacy & Identity – Please respect our Subscribers privacy by not contacting them with offers, questions, suggestions or anything which is not directly related to their Volunteering Services or Requests. You may not publish or post other people’s private and confidential information. Any exchange of personal information required for the completion of a service must be provided in the Subscriber’s Page. Subscribers further confirm that whatever information they receive from other Subscribers, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery or receiving of the relevant service as per the Volunteer Well Site.
  - Authentic Volunteer Well Profile – You may not create a false identity on Volunteer Well Site, misrepresent your identity, create a Volunteer Well profile for anyone other than yourself (a real person), or use or attempt to use another user’s Account or information; Your profile information, including your description, skills, location, etc., while may be kept anonymous, must be accurate and complete and may not be misleading, illegal, offensive or otherwise harmful. Volunteer Well reserves the right to require Subscribers to go through a verification process in User to use the Site (whether by using ID, phone, camera, etc.).
  - Fraud / Unlawful Use – You may not use Volunteer Well Site for any unlawful purposes or to conduct illegal activities.
  - Abuse and Spam- To prevent fraud and abuse, Subscribers are limited to one active Account. Any additional Account determined to be created to circumvent guidelines, promote competitive advantages, or mislead the Volunteer Well community will be disabled. Mass Account creation may result in disabling of all related Accounts.

Targeted Abuse – We do not tolerate Subscribers who engage in targeted abuse or harassment towards other Subscribers on Volunteer Well Site.

Shipping Physical Deliverables- The Volunteer Well Site can not be used for any shipping offers or to have physical deliverables sent to Users in any shape or form. The charity does not recommend, handle or guarantee any shipping, tracking, quality, and condition of items or their delivery and shall not be responsible or liable for any damages or other problems resulting from shipping if the subscribers, either as Volunteers or Users, opt for physical delivery via this Site in any shape or form.

VOLUNTEERS

Basics

Volunteers list their services, products, skills, hours, etc. as Volunteer Services on Volunteer Well Site to allow Users to opt for and use their services.

Volunteers may also offer Custom Offers to Users in addition to their Volunteer Services.

Volunteer Well is open to everyone. You undertake not to discriminate against any Subscriber, User or Volunteer of this forum based on gender, race, age, religious affiliation, sexual orientation or otherwise you acknowledge that such discrimination may result in the suspension/removal of your Account.

You may not charge any fee or price for your Volunteer Services that you offered on Volunteer Well Site. Please keep in mind that Volunteer Well Site is a volunteering platform and the Volunteer services are offered here free of cost to the Users.

Each User who successfully completes the provision of your Volunteer Services accredits your Account with a review and add to ‘the people/household served’ numbers on your dashboard.

The Volunteer’s rating is calculated based on the User reviews posted by Users. High ratings allow Volunteers to be shown as highly rated volunteer services on the Volunteer Well Site. In certain cases, exceedingly low ratings may lead to the suspension of the Volunteer’s Account.

For security concerns, Volunteer Well may temporarily disable a Volunteer’s ability to post or offer the desired Volunteer Services on the Site to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by other Subscribers, Volunteers and/or Users, or associating multiple Accounts on the Site to a single individual.

Volunteers are responsible for obtaining a general liability insurance policy with coverage amounts that are sufficient to cover all risks associated with the performance of their Volunteering services.

Volunteers that are removed for violations as per the above section titled “Some Non-Permitted Usage of the Volunteer Well Site” may result in the suspension of the Volunteer’s Account.

Volunteers that are removed for violations are not eligible to be restored or edited.

Volunteers may be removed from our Search feature due to poor performance and/or user misconduct.

Volunteers containing websites promoting content, which violates Volunteer Well’s Terms of Service will be removed.

Volunteers are required to have an appropriate Volunteer image related to the service offered. Volunteers must deliver the same quality of service as shown on their Volunteer Offer. Recurring deliveries that don’t match the quality shown on the Volunteer Account on the Site may lead to the Volunteer’s Account losing Volunteer status or becoming permanently disabled.

Volunteers may contain an approved Volunteer Image or multiple images as uploaded through the Volunteer management tools available on Volunteer Well.

Statements on the Volunteer Page that undermine or circumvent these Terms of Service is prohibited.

Volunteer Subscription

Volunteer Well is a community volunteering platform and is all about helping Volunteers leverage and promote their Volunteer Services, while at the same time be able to give back to their communities. We seek to empower the Volunteers with helpful tools to grow their business, while at the same time be able to give back to their communities by being socially responsible through a lens of social inclusion. Volunteers who invest in self-promotion as socially responsible ones may achieve higher philanthropic gratification as well as greater customer satisfaction and reach. And, if they deliver on their offer, in time and maintain high quality and ratings, Volunteer Well would stand with them with new statuses, special opportunities, benefits, and tools that come with it. On the other hand, those Volunteers who cannot maintain their high-quality service, experience a severe drop in ratings, or stop delivering on time risk losing their Volunteer status and the benefits that come with it.

USERS

Basics

You may not offer payments to Volunteers through the Volunteer Well platform, since this is a Volunteer Resources Centre. All the Volunteer Services here, should be offered to you free of cost. Please report any violations of this here [email protected]

Users may request a specific service from the Post a Request feature. Services requested on Volunteer Well must be an allowed service as per these Terms and Conditions and as per the defined categories. Please see the categories link and description for guidelines on Volunteer Well approved services.

For security concerns, Volunteer Well may temporarily disable a User’s ability to receive or request the desired Volunteer Services on the Site to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by other Subscribers, Volunteers and/or Users, or associating multiple Accounts on the Site to a single individual.

Users should refrain from using the Post a Request feature for any purpose other than looking for services on Volunteer Well as per these categories.

Using Volunteer Service

This is a volunteering platform, hence Volunteer Services offered here should be free of cost. Please report any violations. In addition, Users can request a Custom Offer which addresses their specific requirements, and receive a Custom Offer from Volunteers through the site.

You may not offer Volunteers to pay, or make payment for any services offered or used as posted on the Volunteer Well.com site. In case you have been asked to pay, please report it immediately to Customer Support here [email protected].

Reviews

Feedback reviews provided by Users while completing the use of any Volunteer Services are an essential part of Volunteer Well’s rating system. Reviews demonstrate the Volunteer’s overall experience with the Volunteers and their service. Users are encouraged to communicate to the Volunteer any concerns experienced during their use in regards to the Volunteer Service provided by the Volunteer.

Leaving a User’s feedback is a basic prerogative of a User. Feedback reviews will not be removed unless there are clear violations of our Terms of Service.

To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate use of Volunteer Services as offered and executed exclusively through the Volunteer Well Site from users. Uses arranged, determined to artificially enhance Volunteer ratings, or to abuse the Volunteer Well platform with use from additional Accounts, will result in a permanent suspension of all related Accounts.

Feedback comments given by Users are publicly displayed on the Site.

GENERAL TERMS & CONDITIONS

In the event of disagreement with the Terms, Subscriber, whether as Volunteer or as User, is not authorized to visit, access, offer and/or use any Volunteer Services via Volunteer Well.
The Charity reserves the right to modify, suspend or cease certain or all parts on the Site at any time without prior notice. Subscriber’s continued visitation and/or use of organisation services will constitute agreement to comply with updates.
In the event that the service is performed on either the User’s or the Volunteer’s premises, the premise owners are encouraged to maintain proper insurance policies to cover their liability as the premise owner.
Use of the Site, any services by the Charity, the Volunteer Well platform or any of the Charity’s name or related services for personal, commercial or any other reason is strictly forbidden. The Charity holds the right to take legal or required action against the Subscriber.
Feedback and suggestions provided by the Subscriber will be taken as non-confidential and Volunteer Well has the right to use it in any manner it believes appropriate.
We encourage our Subscribers, Users and Volunteers to carry out their own due diligence to vet other subscribers in the course of their offering or seeking of any volunteer services via the Site as well as to settle conflicts amongst themselves directly.
Volunteers donating their time and services, as well as Users requesting for Volunteer Services, can register with Volunteer Well Site as Subscribers. The Volunteer Well has the right to accept or not accept the Subscribers.
At the time of registration, Subscribers shall confirm that the required information provided is current, accurate and complete. Subscribers are also required to update their personal details or other changes with Volunteer Well Site, whenever applicable.
Volunteer shall agree to serve only as volunteer and no association of an employer and employee will be maintained between Volunteer Well and them as well as between any of the Users or other Subscribers. Claim for employment and/or internship and /or any associated risks of such arrangement will not be entertained by Volunteer Well during or after the expiry of their Volunteering services.
Subscribers, whether as Volunteers or Users, are expected to keep the data of other Subscribers, whether as their volunteer or user of the Volunteer Services, that they happen to get access to via the Site, as strictly private and confidential. Additionally, if any subscriber comes across any confidential social, medical, personal and/or financial information about another Subscriber, strict confidence must be maintained.
Subscribers, whether as Volunteer or User, shall acknowledge the possibility of unknown and unforeseen risks while volunteering or receiving the Volunteer Services and accept that Volunteer Well cannot guarantee their safety at any time of their service.
Volunteer Well adheres to a strict non-discriminatory policy to ensure that Volunteers cannot deny any individual access to and/or be discriminated against in any Volunteer Service due to race, faith, culture, religion, gender, beliefs, sexual orientation, background or other factors.
Subscribers are strictly advised not to participate in such offenses as it will result in instant dismissal from the Site. The Site of Volunteer Well is strictly based on social inclusion and basic human rights for every member of the community and discrimination of any sort will not be tolerated.
THE CHARITY, Volunteer Well Site, any of its directors, employees, representatives, partners, licensors, associates or subsidiaries, does not provide any guarantee and is not responsible for any services, transactions, money transfers, shipping or exchanges of any sort. All Subscribers, Users and Volunteers have to do their own due diligence.
THE CHARITY and Volunteer Well Site does not guarantee the behavior, conduct, safety, suitability or ability of either Users or Volunteers. Both Users and Volunteers agree that the entire risk arising out of their use or performance of these Volunteer Services remains solely with them, and THE CHARITY, Volunteer Well Site, any of its directors, employees, representatives, partners, licensors, associates or subsidiaries has no responsibility or liability related to any Volunteer service provided by Volunteers or used by Users.
